class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">El 11 de julio de 2024, mediante acuerdo n\u00famero ACDO.AS2.HCT.250624\/204.P.DIR dictado por el Consejo T\u00e9cnico del Instituto Mexicano del Seguro Social (IMSS), se emiti\u00f3 el criterio normativo N\u00famero 02\/2024\/NV\/SBC-LSS-27-V para orientar a los patrones sobre las caracter\u00edsticas que deben cumplir los conceptos de alimentaci\u00f3n y habitaci\u00f3n, para ser excluidos de la base de cotizaci\u00f3n o, en su caso, su correcta integraci\u00f3n a la misma.<\/p>\n<p style=\"text-align: justify;\">Al respecto, se se\u00f1ala que dichas prestaciones s\u00f3lo podr\u00e1n exceptuarse del salario base de cotizaci\u00f3n cuando hayan sido entregadas en especie, por lo que aquellas cantidades entregadas en efectivo o depositadas en la cuenta de los trabajadores por concepto de alimentaci\u00f3n o habitaci\u00f3n deber\u00e1n integrarse al salario base de cotizaci\u00f3n en t\u00e9rminos de lo previsto en el primer p\u00e1rrafo del art\u00edculo 27 de la Ley del Seguro Social.<\/p>\n<p style=\"text-align: justify;\">Asimismo, mediante comunicado n\u00famero 352\/2024 publicado tambi\u00e9n el 11 de julio de 2024, el IMSS precis\u00f3 que los conceptos de alimentaci\u00f3n y habitaci\u00f3n s\u00f3lo podr\u00e1n excluirse de la base de cotizaci\u00f3n, si cumplen con las siguientes condiciones:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Se otorgaron de forma onerosa;<\/li>\n<li>Fueron entregados en especie (incluyendo mediante vales);<\/li>\n<li>Est\u00e1n debidamente registrados en la contabilidad del patr\u00f3n;<\/li>\n<li>Fueron efectivamente utilizados para alimentaci\u00f3n o habitaci\u00f3n.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Con base en lo anterior, el IMSS se\u00f1al\u00f3 las siguientes pr\u00e1cticas fiscales indebidas:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Quien excluya de la base de cotizaci\u00f3n las cantidades entregadas en efectivo o depositadas en la cuenta de los trabajadores, por concepto de alimentos y habitaci\u00f3n.<\/li>\n<li>Quien simule la retenci\u00f3n de importes para demostrar que los conceptos de alimentos y habitaci\u00f3n fueron onerosos, cuando en realidad los importes constituyen remuneraciones pagadas que deben integrarse a la base.<\/li>\n<li>Quien asesore, aconseje, preste servicios o participe en la realizaci\u00f3n o implementaci\u00f3n de las pr\u00e1cticas anteriores.<\/li>\n<li>Todo contador p\u00fablico autorizado que emita opini\u00f3n de cumplimiento \u201climpia y sin salvedades\u201d, en el dictamen en materia de seguridad social de patrones que incurran en las conductas anteriores.<\/li>\n<\/ul>\n<p
