El pasado 7 de junio fue publicada en el Diario Oficial de la Federaci\u00f3n (el \u201cDOF\u201d), el Decreto a trav\u00e9s del cual se reforman, adicionan y derogan diversas disposiciones de la Ley del Seguro Social, en materia de herramientas digitales.<\/p>\n

Anteriormente, las notificaciones electr\u00f3nicas eran opcionales y requer\u00edan la conformidad expresa del patr\u00f3n o sujeto obligado. A trav\u00e9s de dicha reforma, se establece formalmente la operaci\u00f3n y administraci\u00f3n del nuevo Buz\u00f3n IMSS, como un sistema de comunicaci\u00f3n electr\u00f3nico, en el cual el Instituto Mexicano del Seguro Social (el \u201cIMSS\u201d) podr\u00e1 realizar citatorios, notificaciones, emplazamientos de cualquier acto, requerimientos de informaci\u00f3n o resoluciones administrativas que emita en documentos digitales.<\/p>\n

Por su parte, los particulares podr\u00e1n presentar promociones, solicitudes, avisos o dar cumplimiento a sus obligaciones y requerimientos, as\u00ed como realizar consultas sobre su situaci\u00f3n fiscal y administrativa ante el Instituto.<\/p>\n

Es importante destacar que las actuaciones realizadas a trav\u00e9s del Buz\u00f3n IMSS, el cual se implementa en la p\u00e1gina electr\u00f3nica del IMSS www.imss.gob.mx<\/a>, producir\u00e1n los mismos efectos legales que los documentos firmados aut\u00f3grafamente y, en consecuencia, tendr\u00e1n el mismo valor probatorio.<\/p>\n

Cuando las personas particulares no habiliten, se\u00f1alen datos err\u00f3neos, no registren o no actualicen sus medios de contacto, el IMSS podr\u00e1 efectuar sus notificaciones por estrados.<\/p>\n

Por lo anterior, el IMSS deber\u00e1 emitir dentro de los 60 d\u00edas posteriores a la publicaci\u00f3n de la citada reforma, los tr\u00e1mites y servicios disponibles en el Buz\u00f3n IMSS, as\u00ed como sus reglas de car\u00e1cter general para su operaci\u00f3n.<\/p>\n

En tanto no se publiquen dichas reglas generales, ser\u00e1n aplicables los \u201cLineamientos Generales para el Uso del Buz\u00f3n IMSS\u201d, aprobados por el H. Consejo T\u00e9cnico mediante Acuerdo ACDO.AS2.HCT.240620\/170.P.DIR, publicado el 9 de julio de 2020 en el DOF.<\/p>\n
