Decree “Plan Mexico” Tax Incentives

In line with the “Plan Mexico” presented on January 13, 2025 by the head of the Federal Executive, which contemplates certain initiatives and goals to promote the economic and social development of the country until 2030, on January 21, 2025, the “Decree by which fiscal incentives are granted to support the national strategy called ‘Plan Mexico’, to promote new investments that encourage dual training programs and promote innovation” was published in the Official Gazette of the Federation (DOF, for its acronym in Spanish). The Decree establishes two tax incentives applicable to companies taxed under the general regime or the simplified trust regime, as well as to individuals with business and professional activities.

1.  Immediate deduction of investments

This tax incentive consists, in general terms, of the immediate deduction of the investment made in new fixed assets acquired as of the entry into force of the referred Decree and until September 30, 2030, destined exclusively to the performance of its main activity, through the application of percentages higher than those established in the Income Tax Law for the investments in question.

2. Additional deduction for training and innovation expenses

Through this tax incentive, an additional deduction is granted equivalent to 25% of the increase in: a) the expenses incurred for training received by each active worker registered with the Mexican Social Security Institute, and b) innovation expenses related to investment projects for obtaining patents or initial certifications required by taxpayers for their integration into local/regional supply chains.

 

For purposes of these incentives, an “Evaluation Committee” will be created to analyze the requirements to be met by the investment projects, as well as to issue the certificate of compliance to the taxpayers interested in applying the referred incentives.

We recommend a careful review of the applicable requirements for each tax incentive, as well as the cases of exception.

Likewise, with the entry into force of the above mentioned Decree, the “Decree by which tax incentives are granted to key sectors of the export industry, consisting of the immediate deduction of the investment in new fixed assets and the additional deduction of training expenses”, published in the DOF on October 11, 2023, as well as the amendments to the same published on December 24, 2024, are no longer in effect. In general terms, such Decree contemplated the tax incentives described above with some fundamental differences, such as the fact that the incentives were applicable only to certain taxpayers in certain industries and that their application was not subject to approval by an Evaluation Committee.

Financial Statement Report for Tax Purposes (SIPRED 2024) Type I

On January 20, 2025, Annex 16 “Report of financial statements for tax purposes (SIPRED 2024) Type I” of the Miscellaneous Tax Resolution for 2025 was published in the Official Gazette of the Federation, which contains the instructions for integration and characteristics, the guide formats for the presentation of the report of financial statements for tax purposes issued by a registered public accountant and the questionnaires related to the review made by the public accountant, for the fiscal year 2024, information that is applicable, among others, to the general financial statement report for tax purposes.

National Consumer Price Index

Today, the National Institute of Statistics and Geography (INEGI) published the National Consumer Price Index (NCPI) for the month of December 2024, which corresponds to 137.949, in the Official Gazette of the Federation.

Said index shows a variation of 0.38 percent with respect to the index corresponding to November 2024, which was 137.424, generating an accumulated inflation for the 2024 fiscal year of 4.21 percent.

Master Plan 2025

The Tax Administration Service (SAT) through its Press Release 01/2025 announced the “Master Plan 2025”, in which it establishes the actions to reach the collection goal of 5.3 trillion pesos for fiscal year 2025, without the need to create or increase taxes, as well as to promote a civic culture of taxation, which is based on three main axes:

1. Attention to taxpayers

Simplification of procedures and services with the highest demand, such as registration in the Federal Taxpayers Registry (RFC) and e.firma, will be carried out. The SAT’s portal will be renewed, the use of mobile applications for filing and paying tax returns, consulting the tax mailbox, compliance and invoicing opinions, as well as implementing new facilities for the Simplified Trust Regime (RESICO) will be promoted.

2. Accompanying the compliant taxpayer

The program highlights the Tax Regularization for small taxpayers with income up to 35 million pesos, who will be able to cover their tax debts with a 100% reduction on surcharges, fines and execution expenses.

The pre-filling of returns is enabled for companies in the primary sector, the Coordinated Regime and the Optional Regime of Group of Companies, with the information of electronic invoices, provisional payments and annual returns.

An update to the information returns platform is foreseen, where they will be able to file online, among others, the Multiple Informative Declaration (DIM), the Informative Declaration of Operations with Third Parties (DIOT), the Multiple Informative Declaration of the Special Tax on Production and Services (Multi-IEPS), facilitating compliance with this obligation.

3. Anti-evasion and anti-smuggling tax audits

SAT will continue to use technological tools for tax audits and the exchange of information with other federal authorities to guarantee the correct compliance of taxpayers’ obligations, will carry out the review of economic sectors with high risk of evasion and planning through its reporting schemes, will strengthen the fight against smuggling and will begin an in-depth audit of foreign trade operations and participants.

Likewise, it will maintain strategic litigation actions in federal courts and will reinforce its participation against tax fraud, smuggling, issuance and use of false tax receipts.

Miscellaneous Tax Resolution for the fiscal year 2025

On December 30, 2024, the Miscellaneous Tax Resolution for 2025 and its Annexes 1, 5, 6, 8, 15, 19 and 27 were published in the Official Gazette of the Federation, which will become effective as of January 1, 2025 and will be in effect until December 31, 2025. Together with any amendments that may be made during said fiscal year, the new law will be effective as of January 1, 2025 and will remain in effect until December 31, 2025.

Subsequent publications will mention the relevant amendments to the Miscellaneous Tax Resolution for 2025.

Press Release SAT - Extension to enable the Tax Mailbox

On December 30, 2024, the Tax Administration Service (“SAT”) issued a press release informing taxpayers of an extension to enable the Tax Mailbox until December 31, 2025; failure to comply with this tax obligation after this deadline will be cause for an infraction, since from the fiscal year 2020, enabling the Tax Mailbox, registering and keeping the means of contact updated is mandatory for all taxpayers, individuals and legal entities registered in the Federal Taxpayers Registry.

We remind you that the Tax Mailbox service is a means of contact and communication by SAT, whose objective is to simplify the notification of administrative acts and the sending of messages of interest in an agile and secure manner to taxpayers. Revocation of Digital Certificates

Today, a massive revocation of digital e.firma certificates for both individuals and legal entities was reported, indicating the status of these certificates as “Revoked as of October 23, 2024.”               

So far, the Tax Administration Service (SAT) has not issued any official communication regarding this situation; however, in recent hours, the status of the e.firma certificates for some taxpayers has been changed to “Active,” suggesting a possible computer error in SAT’s systems.

We recommend checking the validity of your e.firma certificates to ensure they are functioning correctly. Also, stay alert for any reactivation if they still appear with the status of “Revoked.”
