Tax News No 6 – April 2021

1st Resolution of Modifications to the MTR for 2021 Fifth Anticipated Version

On April 5, 2021, the Tax Administration Service (SAT) released through its website the fifth anticipated version of the First Resolution of Modifications to the Miscellaneous Tax Resolution for 2021, in which they are amended, added and repealed several rules.

Among the modifications observed in the version abovementioned, we consider relevant the following rules:

Annual tax return 2020 (individuals)

Rule 13.4. is added to establish that for the purposes of filing the annual tax return of individuals corresponding to the tax year 2020, such individuals may present said declaration no later than May 31, 2021.

Information related to tax situation (related party operations)

 It is added Rule 13.3. which establishes that for the purposes of article 32-H of the Federal Tax Code, taxpayers obliged to submit the information related to their tax situation (ISSIF per its acronym in Spanish ) who had carried out transactions with related parties during 2020, at the moment of filing the corresponding annual tax return, they may decide not include the information related to the sections i) “Information on transactions with related parties” and ii) “Information on their transactions with related parties”, as long as they have an active certificate of e.firma (electronic signature) and the aforementioned information complies with the following:

          i).     The information should be filed no later than September 30, 2021.

          ii).    The information must be sent complete, without errors or inconsistencies and complying with the applicable tax provisions.

          iii).   The information should be sent through the SAT Portal or through the application in accordance with the procedure established in Form 307/CFF “Filing of information                               related to their 2020 tax situation, regarding transactions with related parties”.
